1. Introduction & Acceptance of Terms

Welcome to Makazi Yangu, a Kenyan real estate platform that facilitates connections between tenants, landlords, agents, investors, and other property stakeholders.

By accessing or using our website, mobile app, or services (collectively the “Platform”), you agree to be bound by these Terms and Conditions and our Privacy Policy.

2. Eligibility & Account Registration

You must be at least 18 years old and have legal capacity under Kenyan law to use the Platform. You agree to provide accurate, complete information during registration and keep it updated. You are solely responsible for all activity on your account.

3. User Obligations & Conduct

You agree to act honestly, comply with all Kenyan laws (including the Landlord and Tenant Act), and refrain from discrimination, harassment, or any harmful behavior.

4. Platform Role & Disclaimer of Warranty

We provide the Platform “AS IS” without warranties. We do not verify listings, guarantee property condition, or endorse users.

5. Renters/Tenants' Terms

You are responsible for rent payments, property care, and conducting your own inspections before signing any lease.

6. Landlords/Property Owners' Terms

You warrant that you have legal authority to list properties, that all information is accurate, and that you comply with Kenyan tenancy laws including habitability and deposit rules.

7. Agents/Brokers' Terms

You must hold a valid license from the Estate Agents Registration Board and disclose your agency status and commission structure transparently.

8. Investors/Partners' Terms

You are solely responsible for due diligence and consulting qualified advisors.

9. Payments, Fees, and Commissions

We may charge service, subscription, or transaction fees. All fees are disclosed upfront and are generally non-refundable unless stated otherwise.

10. Prohibited Activities

You may not list fake properties, engage in fraud, spam, harassment, or violate any Kenyan law. Violations may lead to immediate suspension and legal reporting.

11. Privacy & Data Protection

We comply with the Kenya Data Protection Act, 2019. Your data rights and our practices are detailed in our Privacy Policy.

12. Liability, Indemnity, and Limitation

To the fullest extent permitted by law, Makazi Yangu is not liable for indirect or consequential damages. You agree to indemnify us against claims arising from your use of the Platform.

13. Dispute Resolution & Governing Law

These Terms are governed by Kenyan law. Disputes shall first attempt amicable resolution, then mediation, and finally arbitration in Nairobi under the Arbitration Act.

14. Termination & Suspension

We may suspend or terminate your account at any time for breach of these Terms or to protect the Platform and its users.

15. Amendments to Terms

We may update these Terms with reasonable notice. Continued use after changes constitutes acceptance.
